These Terms of Service govern the sale of products from kapowmeggings.co.uk and kapowmeggings.com (the “Site”) when accessed from the United Kingdom and European Union.
By placing an order, you agree to be bound by these Terms.

Kapow Group Ltd is the contracting entity for all orders placed through the UK website, including UK, EU and international orders.
Orders are fulfilled from from our UK and EU fulfilment centres depending on delivery destination.

Formation of Contract
After placing an order, you will receive an order confirmation email. This does not constitute acceptance.
A contract is formed only when we dispatch the product and send a dispatch confirmation email.
We reserve the right to cancel or refuse any order, including for pricing errors, suspected fraud, or unauthorised resale.

Pricing and VAT
All prices displayed on the UK website are inclusive of VAT where applicable.
For EU orders fulfilled from Germany, VAT is charged at the applicable destination rate.
Delivery costs are displayed at checkout.
We reserve the right to correct obvious pricing errors. If a pricing error occurs, we may cancel the order and refund any payment made.

Shipping and Delivery
Delivery times are estimates only and are not guaranteed.
Risk in the goods passes to you upon delivery to the address provided at checkout.
Ownership of the goods passes to you upon delivery and full payment.
Orders may be fulfilled from our UK or EU fulfilment centres depending on delivery destination.
For certain international destinations outside the UK and EU, customs duties, taxes, or import charges may apply. Unless expressly stated at checkout, such charges are the responsibility of the customer.

Your Statutory Right to Cancel (UK & EU Consumers)
If you are a consumer in the United Kingdom or European Union, you have a legal right to cancel your order within 14 days of receiving the goods, without giving any reason.
To exercise this right, you must notify us within 14 days of delivery. You then have a further 14 days to return the goods to us.
If you cancel within this statutory period, we will refund:

- The full product price; and
- The cost of our standard outbound delivery service (if applicable).

If you selected a premium or expedited delivery option, we are only required to refund the cost of our standard delivery service.
Return Shipping Under Statutory Cancellation
Unless otherwise stated at the time of purchase, you are responsible for the cost of returning goods when exercising your statutory right to cancel.
Return costs, where applicable, may vary depending on delivery destination and will be communicated at the time you initiate your return.
Risk of Return Transit
You are responsible for ensuring that returned goods reach us. The risk of loss or damage during return transit remains with you until the goods are received at our fulfilment centre.
We recommend using a tracked and insured shipping method. We are not responsible for items lost or damaged in return transit.
Refunds will not be issued until the returned goods have been received and inspected.
Diminished Value
You are responsible for any diminished value of goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
Trying on garments for fit is acceptable.
Wearing garments for extended use, gym activity, laundering, or any use beyond reasonable inspection may result in a reduction in the refund where the goods cannot be resold.
For health protection and hygiene reasons, the right to cancel does not apply to sealed underwear or intimate garments once the hygiene seal or original protective packaging has been removed after delivery, unless the item is faulty.
Refund Method
Refunds under your statutory right to cancel will be made to the original payment method used for the purchase, unless you expressly agree otherwise. If you request store credit instead of a refund to your original payment method, we may provide this at our discretion.
Refunds under statutory cancellation will be made within 14 days of receiving the returned goods.

30-Day Returns Policy (In Addition to Statutory Rights)
In addition to your statutory cancellation rights, we offer a 30-day returns period from the date of delivery.
This extended returns policy is a commercial benefit provided by us and does not affect your statutory rights.
Eligibility Conditions
To qualify for a return under our 30-day policy:

- Original tags must be attached
- Items must not show signs of wear beyond trying on

For hygiene and quality reasons, we reserve the right to refuse returns where items show signs of wear, damage, odour, laundering, or any condition preventing resale.
Return Shipping Under Our 30-Day Policy
Return shipping arrangements, including whether return shipping is free or chargeable, are governed by our Returns Policy in force at the time of purchase and may vary by country.
Any applicable return fees will be communicated during the returns process.
Risk of Return Transit
Returned goods remain your responsibility until they are received by us. We recommend retaining proof of postage or using a tracked shipping service.
Refunds and Store Credit
Under our 30-day commercial returns policy, refunds will normally be issued to the original payment method used at checkout.
At your request, we may offer store credit instead of a monetary refund. Store credit may be subject to additional conditions, including expiry periods where legally permitted.
We reserve the right to issue store credit instead of a refund in cases of misuse of our commercial returns policy, repeated returns activity, or where permitted by law.
Refunds or exchanges will only be processed once the returned goods have been received and inspected.
We reserve the right to amend our commercial returns policy from time to time. The version in force at the time of purchase applies to your order.

General Refund Provisions

Nothing in these Terms affects your statutory rights in relation to faulty, misdescribed or defective goods. If goods are faulty, misdescribed or not of satisfactory quality, UK consumers have a statutory right to reject the goods and receive a full refund within 30 days of delivery. After 30 days, we are entitled to offer a repair or replacement in accordance with the Consumer Rights Act 2015.
Digital gift cards are non-refundable and do not expire (unless otherwise required by law).
We reserve the right to withhold or refuse refunds where goods are not received, are returned in breach of these Terms, or where there is evidence of misuse or abuse of our returns policy, except where prohibited by law.

Our products are athletic and fashion garments.
They are not medical devices and are not intended to provide medical benefits.
Any references to compression, performance, sweat-wicking or support are general athletic descriptions and do not constitute medical claims.

We reserve the right to cancel orders placed using improperly obtained or misused discount codes.

Anti-Resale Policy
Products are sold for personal use only.
We reserve the right to cancel bulk orders or orders suspected of resale.
Unauthorised resale of products as new, or representation as an authorised distributor, is prohibited.
This does not restrict lawful resale of used goods by consumers.

Reviews and User Content
By submitting reviews or content, you grant us a worldwide, royalty-free licence to use, reproduce and display such content.
We reserve the right to moderate, remove or refuse content at our discretion.

Limitation of Liability
Nothing in these Terms excludes or limits liability for:

- Death or personal injury caused by negligence
- Fraud or fraudulent misrepresentation
- Breach of statutory consumer rights

Subject to the above, our total liability shall not exceed the purchase price of the relevant product.
We are not liable for indirect or consequential loss, loss of profit, loss of business, or loss of opportunity.

Force Majeure
We are not liable for delays or failure to perform caused by events beyond our reasonable control.

Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales.
UK consumers: disputes shall be subject to the courts of England and Wales.
EU consumers: you may also bring proceedings in your country of residence as required by applicable consumer protection laws.

Changes to These Terms
We may update these Terms from time to time.
